Este marco ha transformado la log\u00edstica, con un foco especial en la log\u00edstica inversa y el cumplimiento normativo por parte de productores, consumidores industriales y operadores log\u00edsticos.<\/p>\n<h3 style=\"text-align: justify;\">PRODUCTORES Y CONSUMIDORES INDUSTRIALES<\/h3>\n<p style=\"text-align: justify;\">Seg\u00fan el DS N\u00b0 12 y la Resoluci\u00f3n Exenta N\u00b0 2084, un productor es quien introduce productos prioritarios al mercado nacional, ya sea mediante fabricaci\u00f3n, importaci\u00f3n o comercializaci\u00f3n bajo su marca. Para el caso de envases y embalajes un productor ser\u00e1 quien genera m\u00e1s de 300 kilos de residuos al a\u00f1o.<\/p>\n<p style=\"text-align: justify;\"><img decoding=\"async\" class=\" alignleft size-full wp-image-15152\" src=\"https:\/\/www.revistalogistec.com\/wp-content\/uploads\/2024\/06\/Gustavo_Villena.jpg\" alt=\"Gustavo Villena\" width=\"200\" style=\"margin: 10px; float: left;\" srcset=\"https:\/\/www.revistalogistec.com\/wp-content\/uploads\/2024\/06\/Gustavo_Villena.jpg 200w, https:\/\/www.revistalogistec.com\/wp-content\/uploads\/2024\/06\/Gustavo_Villena-150x150.jpg 150w, https:\/\/www.revistalogistec.com\/wp-content\/uploads\/2024\/06\/Gustavo_Villena-75x75.jpg 75w\" sizes=\"(max-width: 200px) 100vw, 200px\" \/>Por su parte, un consumidor industrial es todo establecimiento de car\u00e1cter industrial que genere residuos de un producto prioritario, de acuerdo a la Ordenanza General de Urbanismo y Construcciones. Es com\u00fan referirse al \u00abpatio trasero\u00bb para describir el espacio donde acumulan residuos como envases y embalajes entre otros. Los consumidores industriales tienen un rol clave: deben asegurar la correcta gesti\u00f3n y disposici\u00f3n final de estos residuos, cumpliendo con los est\u00e1ndares definidos por la Ley REP.<\/p>\n<p style=\"text-align: justify;\">En este contexto, los operadores log\u00edsticos tambi\u00e9n pueden clasificarse como consumidores industriales cuando gestionan residuos generados por sus actividades operativas.<\/p>\n<h3 style=\"text-align: justify;\">LA LOG\u00cdSTICA EN LA LEY REP<\/h3>\n<p style=\"text-align: justify;\">La log\u00edstica, y en particular la log\u00edstica inversa, es esencial para cumplir los objetivos de la Ley REP. Implica gestionar el retorno de productos desde el \u00abpatio trasero\u00bb de los consumidores hasta puntos de reciclaje o valorizaci\u00f3n. Este proceso requiere tecnolog\u00eda para garantizar trazabilidad y optimizar costos, minimizando el riesgo de sanciones.<\/p>\n<p style=\"text-align: justify;\">La normativa impone deberes claros a los consumidores industriales:<\/p>\n<p style=\"text-align: justify;\">\u2022 Inscripci\u00f3n en el Registro de Emisiones y Transferencias de Contaminantes (RETC): Obligatoria para reportar generaci\u00f3n y disposici\u00f3n de residuos.<\/p>\n<p style=\"text-align: justify;\">\u2022 Participaci\u00f3n en sistemas de gesti\u00f3n autorizados: Encargados de recolectar, gestionar y valorizar residuos en l\u00ednea con las metas legales.<\/p>\n<p style=\"text-align: justify;\">\u2022 Trazabilidad de los residuos: Registrar y reportar la gesti\u00f3n de residuos desde su generaci\u00f3n hasta su disposici\u00f3n final.<\/p>\n<p style=\"text-align: justify;\">\u2022 Cumplimiento de metas de valorizaci\u00f3n: El DS N\u00b0 12 establece un porcentaje m\u00ednimo de residuos que deben ser valorizados, seg\u00fan el producto.<\/p>\n<p style=\"text-align: justify;\">El incumplimiento de estas obligaciones puede derivar en multas de hasta 10.000 Unidades Tributarias Anuales, afectando tanto las finanzas como la reputaci\u00f3n de las empresas.<\/p>\n<h3 style=\"text-align: justify;\">EL ROL DE LOS OPERADORES LOG\u00cdSTICOS<\/h3>\n<p style=\"text-align: justify;\">Los operadores log\u00edsticos son actores fundamentales para la implementaci\u00f3n de la Ley REP. Sus principales funciones incluyen:<\/p>\n<p style=\"text-align: justify;\">\u2022 Recolecci\u00f3n y transporte de residuos: Desde el \u00abpatio trasero\u00bb de consumidores industriales hasta instalaciones autorizadas.<\/p>\n<p style=\"text-align: justify;\">\u2022 Trazabilidad y reportes: Garantizar registros confiables para las autoridades.<\/p>\n<p style=\"text-align: justify;\">\u2022 Colaboraci\u00f3n con sistemas de gesti\u00f3n: Integrarse a sistemas de gesti\u00f3n de residuos para optimizar procesos y cumplir metas.<\/p>\n<p style=\"text-align: justify;\">\u2022 Capacitaci\u00f3n y sensibilizaci\u00f3n: Educar a su personal y equipos de trabajo sobre sus responsabilidades y mejores pr\u00e1cticas en gesti\u00f3n de residuos.<\/p>\n<p style=\"text-align: justify;\">El caso de EIT Log\u00edstica demuestra c\u00f3mo los operadores log\u00edsticos pueden innovar para adaptarse a las exigencias de la Ley REP, convirti\u00e9ndose en aliados estrat\u00e9gicos de consumidores industriales y sistemas de gesti\u00f3n.<\/p>\n<h3 style=\"text-align: justify;\">BENEFICIOS Y DESAF\u00cdOS DEL CUMPLIMIENTO<\/h3>\n<p style=\"text-align: justify;\">Cumplir con la Ley REP genera beneficios como evitar multas, fortalecer la reputaci\u00f3n corporativa y abrir oportunidades econ\u00f3micas mediante la valorizaci\u00f3n de residuos. Sin embargo, tambi\u00e9n presenta desaf\u00edos, como la necesidad de invertir en tecnolog\u00eda y adaptarse a nuevas exigencias regulatorias. La colaboraci\u00f3n entre productores, consumidores industriales y operadores log\u00edsticos es esencial para superar estos retos y alcanzar las metas de valorizaci\u00f3n establecidas.<\/p>\n<p style=\"text-align: justify;\">La Ley REP representa una oportunidad para transformar la gesti\u00f3n de residuos en Chile, fomentando la econom\u00eda circular.
